Guidepost was engaged to conduct an investigation of unfair competition and anticompetitive practices for a social media marketing company after it was suspended by two prominent social media companies for alleged violations of their Terms of Service. At the time of the suspension, the social media marketing company was producing over eight figures monthly in revenue conducting business on the two social media company platforms. Our investigation found that the alleged Terms of Service violations were unfounded and that the social media companies’ actions were pretextual as they viewed our client as a direct competitor in the emerging web3/metaverse market. Our investigation through various OSINT and HUMINT methods found that the Terms of Service allegations were attributable to corrupt activities and information security vulnerabilities with both social media companies. The results of our investigation were shared with the social media companies and led to a private settlement with one of them and ongoing negotiations to resolve the dispute with the other.
